You retain all rights to your data, AI agent configurations, and outputs generated through our platform. We do not claim ownership of your content or AI agents.

5.3 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use our services for your internal business purposes.

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Service Availability and Support

7.1 Service Level

We strive to provide reliable service but do not guarantee 100% uptime. Planned maintenance and updates may result in temporary service interruptions.

7.2 Support

Support is provided according to your service plan. Enterprise customers receive dedicated support with defined response times.

8. Fees and Payment

11. Limitation of Liability

IN NO EVENT SHALL AETHYR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless Aethyr from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or infringement of third-party rights.

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles.
